Abstract

Regional autonomy constitutes one of the fundamental pillars in the governance system of the Unitary State of the Republic of Indonesia, constitutionally guaranteed under Article 18 paragraphs (2) and (5) of the 1945 Constitution. The phrase “the broadest possible autonomy” (otonomi seluas-luasnya) as enshrined in the Constitution has frequently generated interpretive ambiguity in regional governance practices, particularly in delineating the boundaries of authority between the central government and regional governments. Law Number 23 of 2014 on Regional Government was enacted to clarify the division of governmental affairs; however, its implementation continues to reveal various legal problems concerning the tension of authority between the central and regional governments, especially in concurrent governmental affairs. This study aims to juridically analyze the boundaries of regional government authority in implementing the broadest possible autonomy under Law No. 23 of 2014, as well as to identify legal issues arising from the implementation of such division of governmental affairs. The research employs a normative legal method with a statute approach and a conceptual approach. The findings indicate that although Law No. 23 of 2014 has classified governmental affairs into absolute, concurrent, and general affairs, its implementation still generates normative conflicts, particularly due to the recentralization of authority reinforced by Law No. 11 of 2020 on Job Creation. The principle of the broadest possible autonomy cannot be interpreted as unlimited freedom, but must be exercised within the framework of the unitary state, the Constitution, and applicable legislation.
